SOLCARGO obtains provisional suspension against the increase of CFE tariffs for the transmission (porting) of electrical energy for clean energy generators
SOLCARGO's Administrative Litigation and Energy team, led by our partner Juan Pedro Machado and associates Pilar Galvan and Biuludani Altamirano, obtained an injunction preventing the provisional application of the "Transmission Service Charges for Renewable Energy Sources or Efficient Cogeneration by Voltage Level, at 2018 prices", published in the Federal Official Gazette on June 10, 2020 and Resolution RES/893/2020, adopted on May 28, 2020, by the Plenary of the Energy Regulatory Commission (the " electricity Transmission (porting) Tariffs").
In effect, the Second District Judge in Administrative Matters Specialized in Economic Competition, Broadcasting and Telecommunications, granted this Tuesday June 16, 2020 such suspension for the effect that the Transmission (porting) Tariffs are not applied and, instead, CFE Intermediation of Legacy Contracts, must apply those that were issued in accordance with the methodologies and the reliability policy that prevailed since the Energy Reform that, contrary to those recently published, promoted the use of clean energy.
The determination of the District Judge is fundamental to preserve the rule of law and the certainty of business in the area of electric power generation, through renewable sources.
